The result of the referendum on UK membership of the EU means that over the coming months and years negotiations will be taking place to shape the nature of the UK's exit.
But if you own EU wide IP rights in the form of EU Trade Marks (formerly called Community Trade Marks) and Registered Community Designs, you will be anxious to know how this immediately impacts on these rights.
They key at this stage is don't panic! For now those rights wiill continue to cover the UK. Once the exact form of the exit from the EU has been negotiated we would expect to see some mechanism arranged for the owners of EU rights to translate or re-register their EU Trade Marks and Registered Community Designs so that following exit they will continue in some format to provide UK protection.
Going forward however Brexit will mean that protection strategies will need a rethink. Whilst for now EU rights will continue to provide protection in the UK, it will be advisable for businesses to consider securing separate national UK protection, whilst also looking to secure EU wide protection for their wider international interests.
