Domain Names

Domain registration strategy

With the multitude of domain options available, particularly with the launch of numerous new generic top level domains (gTLDs), it can be daunting to decide just which domains you should register. A strategy can be effectively developed to sit alongside a trade mark protection strategy and/or watching strategy. To find out how Indelible IP can assist please get in touch.

Dispute resolution

Domain names are not themselves classed as a form of IP, but many disputes linked to brands and trade marks do arise. As domains are registered on a first come first served basis issues can arise over who has the right to a domain. And where this also involves inappropriate content on web pages, or demands for payment to release the domain, this can clearly impact on business operations and, potentially, business reputation. For each of the national and generic (gTLD) domains there are dispute resolution systems in place which can often be effectively used to have a domain name transferred. If you have a problem with a domain name please get in touch to find out how Indelible IP can assist.

New gTLD’s

The decision by ICANN (Internet Corporation for Assigned Names and Numbers) to allow hundreds of new gTLDs to become available looked to be a potential nightmare for brand owners as they were faced with potentially having to register hundreds more domains to protect their brands. The Trademark Clearinghouse (TMCH) was introduced to allow brand owners to utilise the “sunrise” registration periods for new gTLD’s but also to provide a notification system to those brand owners when a third party looks to register a domain which matches their brand. Indelible IP can assist with advice on utilisation of the TMCH and any notifications you receive as a result of registration of your brands with them. To find out more please get in touch.

Watching

With the number of permutations possible with each brand name you own it is often not practical to register every available version. However, a domain name watch can identify if there are new registrations which are a little too close for comfort and which may impact negatively on your unique identity and reputation. Indelible IP can assist with maintaining suitable watches and provide advice on any potential issues which arise. For more details of our domain watching services please get in touch.
