What you see is what you get – Modernisation of EU Trade Mark Law

1 October 2017 sees the introduction of further amendments to the EU trade mark system.  One of the key changes is the recognition that, with the way we now approach branding, not all brand elements can be “graphically represented” which until now was a requirement to seek trade mark protection.  Modernisation of the system to allow the submission of trade marks in MP3 and MP4 formats now means that the system will be more useable for those seeking protection of sound, motion, multimedia and hologram trade marks.  This should make it easier to understand simply the extent of trade mark rights, with more of a “what you see is what you get” system.  This may mean an increase in the number of applications for these more unusual types of marks, perhaps reflecting how increasingly important these are as part of modern day branding.

The changes being introduced also include various procedural changes, and the introduction of an EU wide certification mark system.  Certification marks provide a guarantee the goods or services bearing the mark meet certain defined standards or have a certain characteristic, and have been around in the UK for a number of years.
