With the end of the Brexit Transition Period due on 31 December 2020, there will be a number of changes for the owners of EU trade marks going forward.
If you are the owner of an EU trade mark registration or EU design registration, on 1 January 2021 the UK Intellectual Property Office (UKIPO) will automatically create UK registrations that are equivalent to any existing EU registrations. These new “equivalent” registrations will have equal legal standing to existing UK national registrations and will carry the same renewal date. Your EU registrations will continue but will no longer cover the UK. Renewal dates should be carefully checked in the event that the renewal of new UK rights is needed.
If you are the owner of a pending EU trade mark or design application on 31 December 2020, no UK equivalent right will be created. Owners in those instances will be provided with a special “priority” right of nine months, ending on 30 September 2021, to file a new UK application claiming the EU filing details. Your EU application will continue through the ongoing registration process but the granted rights will not cover the UK.
These are the headline changes and there will of course be other impacts on UK/EU trade mark and design matters which may have an impact for you.
